1. Scope

(1) These General Terms and Conditions apply to all orders placed through the online shop of The German Gift Shop by consumers and entrepreneurs.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code – BGB). An entrepreneur is any natural or legal person or partnership with legal capacity who acts in the exercise of their commercial or self-employed professional activity (§ 14 BGB).

(3) The version of these General Terms and Conditions valid at the time of the order shall apply.

(4) The contractual language is German. Translations are provided for information purposes only. In the event of any discrepancy, the German version shall prevail.

3. Conclusion of the Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

(2) By clicking the order button labelled “order with obligation to pay” or with wording that is equally clear regarding the obligation to pay, the customer submits a binding offer to conclude a purchase contract.

(3) The automated confirmation of receipt of the order does not yet constitute acceptance of the offer unless it expressly states that the offer has also been accepted. The purchase contract is concluded by a separate order confirmation or by dispatch of the goods.

(4) Technical processing of the order is carried out via Shopify.

4. Sales via Digital Sales Channels / Agentic Storefronts

(1) Products may also be displayed, recommended or facilitated through digital sales channels provided or supported by Shopify, AI-powered shopping assistants, search systems or chat-based shopping environments, such as Agentic Storefronts.

(2) In such cases, the purchase contract is also concluded exclusively between the customer and The German Gift Shop.

(3) The German Gift Shop remains the seller, contracting party and point of contact for shipping, withdrawal, statutory warranty rights and customer service.

(4) Additional terms of use of the respective platform operators may apply.

5. Prices and Payment

(1) All prices stated are final prices including the applicable statutory value added tax, where applicable.

(2) Any additional shipping costs will be shown to the customer during the ordering process before the order is submitted.

(3) The payment methods displayed in the checkout are available.

(4) Payment is processed by the payment service provider selected by the customer. The contractual, usage and privacy terms of the respective payment service provider may additionally apply to individual payment methods.

(5) Unless otherwise specified for the selected payment method, the invoice amount is due upon conclusion of the contract.

6. Delivery / Shipping

(1) Delivery is made to the delivery address specified by the customer.

(2) Delivery times are stated on the relevant product pages or during the ordering process.

(3) If a product is unavailable, the customer will be informed without undue delay. Any payments already made will be refunded.

(4) Partial deliveries are permitted insofar as this is reasonable for the customer.

7. Product Images / Gift Sets / Handmade Products

(1) Product images are for illustrative purposes. Variations in colour, material nuances or minor design differences may occur for technical, photographic or craftsmanship-related reasons.

(2) Gift sets and product combinations are supplied in accordance with the respective product description. Where an individual offer expressly refers to possible deviations or equivalent substitute products, individual components may, in the event of unavailability, be replaced by products of comparable type, quality and value, provided this is reasonable for the customer.

(3) Handmade products may show minor variations in shape, colour, surface or structure due to the materials used or the manufacturing process. Where such variations are customary for handmade products, reasonable for the customer and do not affect the agreed characteristics of the product, they do not constitute a defect.

(4) Individual product or lifestyle images may have been created or edited using digital image processing or artificial intelligence. The relevant product description and the expressly stated product characteristics are decisive with regard to the condition, scope of delivery and characteristics of the goods.

8. Product Safety

(1) The products offered by us are subject to the applicable statutory requirements concerning product safety, labelling and conformity, in particular Regulation (EU) 2023/988 on general product safety (GPSR), where applicable.

(2) The legally required information for identifying the product and the manufacturer, as well as the warnings and safety information required for the online offer, is provided on the respective product page. Additional labelling, care, usage and safety information may also be provided on the product itself, its packaging or in accompanying documents.

(3) For products whose manufacturer is not established within the European Union, details of the responsible person within the European Union will be provided where required by law.

9. Retention of Title

The goods supplied shall remain the property of The German Gift Shop until payment has been made in full.

10. Right of Withdrawal

Consumers have the statutory right of withdrawal. Details are set out in the separate withdrawal policy available on the website.

The right of withdrawal is excluded in particular for goods made to the customer’s specifications, personalised goods or goods manufactured according to individual customer requirements, to the extent permitted by law.

11. Statutory Warranty Rights

(1) Consumers are entitled to the statutory rights in the event of defects. The statutory liability for defects in goods generally applies for a period of two years from delivery of the goods.

(2) If, in the case of a consumer goods purchase, a condition of the goods that deviates from the statutory requirements becomes apparent within one year from the transfer of risk, the statutory provisions regarding the reversal of the burden of proof shall apply.

(3) Any additional manufacturer’s warranties or other commercial guarantees exist independently of the statutory rights in the event of defects. Such guarantees do not restrict the consumer’s statutory rights.

(4) Where a manufacturer provides a commercial guarantee of durability for a product, we will provide the relevant information in accordance with the applicable statutory information requirements.

(5) The statutory rights in the event of defects also apply to entrepreneurs. Statutory inspection and notification obligations, in particular pursuant to § 377 German Commercial Code (HGB), remain unaffected where applicable.

12. Liability

(1) We shall be liable without limitation in cases of intent and gross negligence and in the event of culpable injury to life, body or health.

(2) In the event of a slightly negligent breach of essential contractual obligations, the fulfilment of which is necessary for the proper performance of the contract and on whose fulfilment the customer may regularly rely, liability shall be limited to the foreseeable damage typical for this type of contract.

(3) In all other cases, liability for slight negligence is excluded to the extent permitted by law.

(4) The above limitations of liability shall not apply where we have fraudulently concealed a defect or have assumed a guarantee, nor shall they apply to claims under the German Product Liability Act or in other cases of mandatory statutory liability.

13. Dispute Resolution

We are neither obliged nor, as a general rule, willing to participate in dispute resolution proceedings before a consumer arbitration board. Irrespective of this, we endeavour to resolve any disagreements with our customers directly and amicably.

14. Final Provisions

(1) German law shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG), provided that this does not conflict with mandatory consumer protection provisions.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be Augsburg, Germany.

(3) Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
