1. Scope

(1) These General Terms and Conditions apply to all orders placed via the online shop of The German Gift Shop by consumers and entrepreneurs.

(2) A consumer is any natural person who enters into a legal transaction primarily for private purposes within the meaning of Section 13 of the German Civil Code (BGB). An entrepreneur is any natural or legal person or partnership with legal capacity acting in the exercise of their commercial or independent professional activity within the meaning of Section 14 BGB.

(3) The version of the General Terms and Conditions valid at the time of the order shall apply.

(4) The contract language is German. Translations are provided for information purposes only. In case of doubt, the German version shall prevail.

3. Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

(2) By clicking the button “Buy now”, “Pay now”, or a comparable order button, you submit a binding offer to conclude a purchase contract.

(3) The contract is concluded by order confirmation by email or by dispatch of the goods.

(4) The technical order processing is carried out via Shopify.

4. Sales via Digital Sales Channels / Agentic Storefronts

(1) Products may additionally be displayed, recommended, or mediated via digital sales channels provided or supported by Shopify, AI-supported shopping assistants, search systems, or chat-based shopping environments, such as Agentic Storefronts.

(2) In these cases as well, the purchase contract is concluded exclusively between the customer and The German Gift Shop.

(3) The seller, contractual partner, and contact for shipping, withdrawal, warranty, and customer service remains exclusively The German Gift Shop.

(4) In addition, the terms of use of the respective platform operators may apply.

5. Prices and Payment

(1) All prices stated are final prices including statutory VAT, where applicable.

(2) Any additional shipping costs are shown separately during the order process.

(3) The payment methods displayed at checkout are available, in particular:

• credit card
• PayPal
• Shopify
• and, where applicable, other payment methods offered.

(4) Payment processing is carried out via the respective selected payment service providers under their own contractual terms, terms of use, and privacy policies. These can be viewed on the respective providers’ websites.

(5) Payment is due immediately upon conclusion of the contract.

6. Delivery / Shipping

(1) Delivery is made to the delivery address provided by the customer.

(2) Delivery times are stated on the product pages or during the order process.

(3) If a product is not available, the customer will be informed without delay. Any payments already made will be refunded.

(4) Partial deliveries are permitted insofar as this is reasonable for the customer.

7. Product Images / Gift Sets / Handmade Products

(1) Product images are for illustrative purposes. Variations in colour, material nuances, or minor design differences may occur for technical, photographic, or craft-related reasons.

(2) Gift sets, packaging, and product combinations may be adjusted with equivalent-quality items if individual components are unavailable, provided this is reasonable for the customer.

(3) Handmade products may show slight individual differences in shape, colour, surface, or structure. These do not constitute a defect.

8. Product Safety

(1) The products offered are subject to the applicable statutory provisions on product safety, labelling, and conformity.

(2) Manufacturer information, warnings, care instructions, or safety information are provided — where required — in the respective product description, packaging, or the delivered product.

(3) Further product-related information may be provided upon request within the scope permitted by law.

9. Retention of Title

The delivered goods remain the property of The German Gift Shop until full payment has been received.

10. Right of Withdrawal

Consumers have the statutory right of withdrawal. Details can be found in the separate withdrawal policy on the website.

In particular, individually made, personalised, or customer-specific products are excluded from the right of withdrawal to the extent permitted by law.

11. Warranty

The statutory warranty rights apply.

For entrepreneurs, the statutory provisions apply with the proviso that obvious defects must be reported without delay.

12. Liability

(1) We are liable without limitation in cases of intent, gross negligence, and injury to life, body, or health.

(2) In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for this type of contract.

(3) In all other respects, liability is excluded to the extent permitted by law.

13. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions conflict with this.

(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Augsburg.

(3) Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
